77-year-old woman evicted from home for cutting down tree without permission

Landlady to receive one thousand euros in compensation



An elderly woman of 77 years will have to abandon the house, in Matosinhos, for having cut, in 2019, a tree without permission of the landlady. The tree in question was more than 50 years old and, according to the court, was "fundamental and striking piece of the property". The woman has lived in this house since 1973.

When confronted with the eviction action, the tenant stated that she was unaware of the value and importance that the Magnolia tree had.

The justification she gave for cutting down the tree was that the shade bothered her and the branches ended up hitting the windows. The gardener in charge of the job later discovered that the branches were rotten and the trunk was infested with worms. To prevent the tree from falling, the gardener said in court that they made the decision to cut it down.

The gardener's testimony was downplayed, since even if the tree had problems, the tenant would always have to report them to the landlady.

After the tree was cut down, the elderly woman no longer opened the door or responded to the landlady's letters, which the judges saw as misconduct.

The tree, a Magnolia, had been in the garden of the villa since 1966, when the landlady's father reportedly built the house. "The Magnolia will never again have the shape or height it had," they said.

In addition to having to leave the house, the elderly woman will have to pay 1,000 euros in compensation for the damage caused.
